This website is operated by East Coast Connect. Throughout these Terms of Service, the terms “we,” “us,” and “our” refer to East Coast Connect.

East Coast Connect operates https://eastcoastconnect.ca/, including all information, content, features, tools, products, and services available through the website.

Our online store is hosted and powered by Shopify, which provides the ecommerce platform that enables us to offer products and services to you.

These Terms of Service govern your access to and use of our website, online store, products, services, features, and communications, collectively referred to as the “Services.”

By visiting our website, purchasing a product, creating an account, submitting information, or otherwise using any part of the Services, you agree to be bound by these Terms of Service and all policies referenced in them.

Any new features, products, services, or tools added to the website will also be subject to these Terms of Service.

Payment-card information is encrypted during transmission using protections provided by our payment processors and ecommerce platform.

Headings used in these Terms of Service are included for convenience only and do not limit or otherwise affect the interpretation of these terms.

4. Accounts and Account Information

We may suspend or terminate an account that contains false information, is used fraudulently, violates these Terms of Service, or creates a security risk.

5. Product and Service Information

We make reasonable efforts to display product descriptions, specifications, dimensions, colours, images, prices, and other information as accurately as possible.

The actual appearance of a product may differ slightly from photographs or images displayed on the website because of lighting, photography, production variations, screen settings, or device displays.

Product descriptions, packaging, designs, features, specifications, and availability may change without notice where permitted by law.

We do not guarantee that every product, service, colour, design, size, or variation displayed on the website will be available at all times.

Products and services may be available exclusively online and may be offered in limited quantities.

Any purchase remains subject to our Return and Refund Policy.

6. Product Use and Safety

Reasons for declining or cancelling an order may include:

A product is unavailable or out of stock.
Product information or pricing contains an error.
Payment cannot be authorized or verified.
Billing, shipping, or contact information cannot be verified.
The order appears fraudulent, suspicious, or unauthorized.
The order violates a purchase limit or promotional condition.
The order cannot legally or safely be fulfilled.
The delivery destination is unsupported or restricted.

If we cancel an order after payment has been collected, we will issue an appropriate refund to the original payment method.

We may limit or prohibit orders that appear to be placed by resellers, distributors, dealers, or other unauthorized commercial purchasers.

If a payment is declined, reversed, disputed, charged back, or identified as unauthorized, we may suspend fulfilment, cancel the order, or take other reasonable action.

10. Promotions and Discount Codes

Promotions, discounts, coupons, credits, and discount codes are subject to the terms displayed with the applicable offer.

Unless expressly stated otherwise, promotional offers cannot be combined, transferred, exchanged for cash, or applied retroactively.

Promotional offers may be limited by date, product, customer, geographic location, minimum purchase, quantity, or availability.

We may cancel or refuse a promotion where we reasonably believe that it has been used fraudulently, improperly, or contrary to its stated terms.

If part of a discounted order is returned, the refund may be recalculated based on the products retained and the conditions of the promotion.

11. Shipping and Delivery

Shipping options, estimated delivery periods, and applicable shipping charges are displayed during checkout where available.

Delivery dates and transit times are estimates unless we expressly state otherwise. They are not guaranteed and may be affected by weather, carrier delays, customs processing, supply disruptions, high order volumes, incorrect addresses, or events outside our reasonable control.

You are responsible for providing a complete and accurate delivery address.

East Coast Connect is not responsible for delays, losses, or additional costs caused by incorrect or incomplete information supplied by the customer, except where required by law.

Where permitted by applicable law, responsibility for a shipment may transfer to you when the order is delivered to the address provided or otherwise completed in accordance with the selected delivery method.

12. International Orders

International orders may be subject to customs inspections, import duties, taxes, brokerage charges, handling fees, and other charges imposed by the destination country or delivery carrier.

Unless expressly stated otherwise during checkout, the customer is responsible for applicable customs duties, import taxes, brokerage fees, and similar charges.

We do not control customs processing or charges imposed by government authorities, customs agencies, or delivery carriers.

You are responsible for confirming that products can legally be imported, possessed, and used in the delivery destination.

13. Returns, Exchanges, and Refunds

Returns, exchanges, cancellations, damaged-product claims, and refunds are governed by our Return and Refund Policy.

You represent that content you submit:

Is accurate and based on your genuine experience where applicable.
Does not violate another person’s intellectual-property rights.
Does not violate privacy, publicity, confidentiality, or contractual rights.
Is not unlawful, threatening, abusive, defamatory, or discriminatory.
Does not contain malicious software, spam, or misleading promotions.
Does not impersonate another person or misrepresent your identity.

We may review, edit, reject, hide, or remove submitted content that violates these Terms of Service or applicable law, but we are not obligated to monitor every submission.

To the fullest extent permitted by law, our total liability arising from a claim connected with the Services or an order will not exceed the amount you paid for the product or transaction giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited or excluded, including mandatory consumer rights and any other liability that applicable law requires us to accept.

24. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless East Coast Connect and its owners, officers, employees, affiliates, agents, contractors, service providers, suppliers, and licensors from third-party claims, losses, liabilities, damages, and reasonable legal costs arising from:

Fraudulent or malicious conduct associated with your account.

This section does not require you to indemnify a party for conduct for which indemnification cannot legally be required.

25. Events Outside Our Control

East Coast Connect will not be responsible for a delay or failure caused by circumstances outside our reasonable control, subject to applicable law.

Such circumstances may include natural disasters, severe weather, fires, floods, epidemics, pandemics, labour disruptions, transportation delays, carrier failures, customs delays, supply shortages, utility failures, internet outages, cyber incidents, government actions, conflict, or civil unrest.

We will make reasonable efforts to manage the effects of such circumstances and resume affected operations when reasonably possible.

26. Severability

If any provision of these Terms of Service is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law.

The unenforceable portion will be treated as severed, and the remaining provisions will continue in effect.

27. No Waiver

A failure or delay by East Coast Connect in exercising a right or enforcing a provision does not waive that right or provision.

A waiver is effective only when expressly provided in writing by an authorized representative of East Coast Connect.

28. Termination

These Terms of Service remain effective unless terminated by you or East Coast Connect.

You may terminate your use of the Services at any time by discontinuing use of the website and, where applicable, requesting closure of your customer account.

We may suspend or terminate your access if we reasonably believe that you have violated these Terms of Service, used the Services unlawfully, engaged in fraud, or created a security or operational risk.

Obligations and liabilities incurred before termination will survive termination where appropriate, including payment obligations, intellectual property provisions, disclaimers, limitations of liability, indemnification, and dispute-related provisions.

29. Entire Agreement

These Terms of Service, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any other policies or terms posted through the Services, constitute the entire agreement between you and East Coast Connect concerning your use of the Services.

These terms replace prior or contemporaneous communications, proposals, and agreements concerning the same subject matter.
